‘Cyber bullying’ bill added to TN harrassment law


A new bill, which was signed into law by Gov. Bill Haslam, on May 30, amends Tennessee law governing harassment to require Internet service providers to “open to inspection” all images or communications to municipal, county and state law enforcement officials during “ongoing investigations or prosecutions.”

The amendment affects change in several parts of Tennessee’s harassment law, TCA 39-17-308.

Subsection (d)(3)(A), which was created by the bill, states “communications shall only be open to inspection by the Internet service provider if the district attorney reasonably believes:

(i) The information sought is not protected from disclosure by any applicable privilege;

(ii) The evidence sought is essential to the successful completion of an ongoing investigation or prosecution; and

(iii) There is no other feasible alternative to obtain the information.”

Additionally, the law is amended to restrict law enforcement officers and district attorneys from “divulging” any information they gain from the inspection of such ISP information, with one exception.

Subsection (d)(3)(B), which is another new section of the law, states “No officer or district attorney having knowledge by virtue of the officer or attorney’s office of the log files, images, or communications shall divulge the knowledge, except in connection with an ongoing investigation or prosecution.”

The amendment also adds ‘social networks’ to the list of ISP activities covered under the law, and defines ‘log files’ as “computer-generated lists that contain various types of information regarding the activities of computers, including, but not limited to, time of access to certain records, processes running on a computer or the usage of certain computer resources.”
